These Terms and Conditions form a legally binding agreement between you, the holiday guest, and Seaside Hospitality Pty Ltd (ABN 69 670 531 414) trading as Book the Bay Port Stephens (“the Facilitator”), acting on behalf of the property owner.

By proceeding with your booking, you agree to all terms outlined below. Breach of these conditions may result in booking cancellation, denied access, or eviction without refund.

General Terms

  1. Code of Conduct
    All bookings are subject to the NSW Code of Conduct for the Short-Term Rental Accommodation Industry. This code applies to owners, agents, and guests. You can view the full Code here.

  2. Respect for Staff
    Book the Bay has a duty of care to its team. Abusive or threatening behaviour towards staff or contractors will result in immediate termination of your stay.

  3. Strata or Community Title Rules
    If the property is part of a strata or community title, all relevant rules must be followed.

  4. Check-in/Check-out
    Unless otherwise agreed in writing:

  • Check-in: From 2:00pm

  • Check-out: By 10:00am

  1. Licence to Occupy
    Your payment secures a temporary licence for short-stay purposes only. No commercial activity or parties are permitted. For bookings over 21 nights, a mid-stay clean is required at the guest’s cost.

  2. Suitability & Neighbouring Works
    Guests must ensure the property suits their needs before booking. No compensation is provided for disturbances from neighbouring construction.

  3. Guest Information
    All guests (including full names and mobile numbers) must be declared at the time of booking. No additional visitors are permitted.

  4. Credit Card Charges
    By booking, you authorise Book the Bay to deduct charges for late check-out, excess cleaning, rubbish removal, or property damage.

  5. Linen
    Linen is included unless stated. Hire can be arranged at an additional cost for Shoal Court and Portofino where linen is not supplied.

  6. Pets
    Only properties listed as pet-friendly allow pets. Guests must clean up after pets and cover any associated cleaning or repair costs.

  7. Locked Out?
    Call 02 4980 4400. An $80 call-out fee may apply after hours.

  8. Lost Keys/Remotes
    Replacement costs for lost keys, garage remotes, or access fobs are the guest’s responsibility.

  9. Cleanliness Upon Departure
    Guests must leave the property clean, locked, and free of rubbish. Dishes must be washed, dried, and packed away. Additional cleaning will be charged.

  10. Guest Belongings
    Book the Bay and property owners are not responsible for guest belongings or vehicles.

  11. Property Owners
    Reserve the right to cancel your booking. If a property leaves the holiday letting pool, we will endeavour to offer alternative choices however ultimately your booking may be cancelled. This also occurs should a property experience an emergency issue where it can not accommodate guests.

  12. Neighbour Respect
    Guests must not:

  • Create disruptive or excessive noise

  • Behave violently or threateningly

  • Cause damage to property, public areas, or neighbours’ belongings
    This is outlined in Section 2.5.2 of the Code of Conduct.

  1. Security
    Guests agree to secure the property when unattended.

  2. No Smoking
    Smoking is not permitted inside any property and is strictly prohibited. Exterior balconies in unit buildings is also not permitted and is against Strata By-Laws. Deodorising charges apply if breached.

  3. Access for Repairs
    Book the Bay and tradespeople may access the property to carry out maintenance or resolve issues.

  4. Reporting Issues
    Guests must report any issues on arrival. Reasonable steps will be taken to rectify concerns, but no refunds will be provided unless a major issue occurs.

  5. Tariffs
    Pricing is subject to change.

  6. Policy Changes
    Terms may be updated without notice.

Cancellations

  1. A full refund is applied if a booking is made and cancelled within a 48hour period

  2. Cancellations Due to Breach
    No refund is offered if your booking is cancelled due to a breach of these terms or the Code of Conduct.

  3. No refunds
    If booking is cancelled 7 days prior to arrival. 21 days during peak season ie 20th Dec to 15 Jan. Should you need to cancel due to unforeseen circumstances, and we are able to fill or partly fill your booking dates, revenue from that obtained booking can be refunded less an administration fee of $100.00.

  4. Payments
    All refunds are processed via bank transfer. It is the guest’s responsibility to provide accurate details.
